Do you need a survey to close?

In Texas, a seller can attest on TDI Form T-47 that nothing has changed since an existing survey, when the buyer or lender wants area and boundary coverage.

Lenders and title companies

The T-47 says the title company relies on the affidavit and the existing survey to give area and boundary coverage, and may still take exceptions.

Among other things, the affiant confirms there have been no changes in the location of boundary fences or boundary walls since the survey.

Texas A&M's Real Estate Research Center explains that to amend the area and boundary exception, the title company may require a survey of improvements and easements.

Where surveys are not commonly required, Fannie Mae says the lender must provide an ALTA 9 endorsement.

Where neither a survey nor that endorsement is customary, Fannie Mae requires a title policy without a survey exception.

Turnaround

Arkansas rules require plat copies to reach the client and the State Surveyor within 30 days after the survey is complete; this is a rule deadline, not a typical turnaround.

Missouri allows subdivision monuments to be set up to 12 months after the plat is recorded when construction could destroy them.
